Hola Marina Sol Owners!
Your Board of Directors (BOD) is pleased to provide this brief summary of the recent activities at Marina Sol. We welcome your comments and questions.
Board Meetings: The BOD met as scheduled on Thursday, November 10th in the MSHOA office. All members of the BOD and Vigilance Committee (VC) were at the meeting in addition to owners Bill Gardner, Rick Greenhead, Adriana Kenlan, Leticia Tolosa Rendon and Karen Will. Highlights of the various meeting topics are reviewed below. The Board also met again briefly late on Saturday to elect officers and set the 2012 meeting calendar. Officers and meeting dates are listed below. Please remember that BOD meetings are open and owners are encouraged to attend.
General Assembly: The General Assembly (GA) meeting was held on Saturday, November 12th in the Marina Sol Club House. Highlights of various meeting topics are reviewed below.
Budget: The final budget approved by the GA set total fees billed to owners for 2012 at $.2718 per foot per month, a reduction (second year in a row) of $.0123 or 4.35% from the previous year. It contains a 4% inflation factor over 2011 for most expenses, small increases for employees, funds an additional deposit to the employee retirement fund, and seals the roof of the “A” building. Copies of the approved budget are available by contacting any board member or the MSHOA office.
Old Restaurant: The buyers are moving forward with the purchase and hope to have the paper work completed in the near future.
Security – Perimeter Gates: To further improve security, the BOD with the help of the Security Committee is looking at other methods to secure the perimeter gates to include electronic key pads.
Cabo Villa: The property adjoining Marina Sol behind the "E" building is owned by Cabo Villa. They have been dumping dirt and other fill which has been accumulating against the Marina Sol perimeter wall creating some damage and concern about potential failure. After several requests from Manager Lucia Fregoso and attorney Susanna Gonzalez, Cabo Villas has removed the material. Manager Fregoso is working on bids for the wall repairs.
Condo Law: New laws governing condominiums on the Baja were passed in 2007. Until such time as we 1) amend our current bylaws or 2) formally adopt the new condo law, Marina Sol will continue to be governed by the old law. In preparation for a recommendation to the GA, the BOD had a translation of the new law (at no cost) and contracted with attorney/official translator Susana Gonzalez for an official translation of the old law (which has been posted to the web site). During initial review of the two documents, the BOD noted several irregularities in the new law translation. Upon further inquiry, it was learned that the translator was not well versed in nor certified to translate legal documents. As a result, the BOD contracted with Attorney Gonzalez for a translation of the new law which has been posted to the web site. The BOD intends to bring a recommendation to the GA at the November, 2012 meeting.
Satellite Dishes: The BOD has recently received several requests for permission to install satellite dishes. To insure uniformity and to protect the association, the BOD has adopted a policy regarding the installation and use of these dishes (available on the web site).
Oasis: The lease for the Oasis will expire on June 30, 2012. The BOD will prepare a request for proposal for distribution by February 1, 2012. The intent is to solicit proposals from potential operators to provide restaurant/bar services. The BOD plans to interview final candidates and award the lease at the March board meeting.
Garage for Rent: Do you need more storage in Cabo? MSHOA recently accepted possession of Garage C04 and is looking to rent it. Please contact General Manager Lucia Fregoso if you are interested.
Water: Marina Sol has been served by two water sources; a well and metered city water. The BOD recently learned that previous general managers did not file the necessary paperwork to maintain and preserve the well. As a result, we lost the rights to that water source. The BOD has retained counsel who is working to recover those rights. The water situation is exacerbated by spotty service from the City of Cabo, often going for days without water. We are installing additional water storage in the “A” building garage and pursuing an additional water line from the city. Needless to say, our water issues would be significantly worse were it not for the recent water line replacements, pool repairs, water treatment system and other conservation measures. Homeowners can improve our conservation efforts by installing low flush toilets, low flow shower heads and promptly repairing running toilets.
Titles/Trust Documents: A recent review of the files noted that the MSHOA office does not have copies of trust/title documents for many units. General Manager Lucia Fregoso will be contacting those owners soon requesting copies. Please assist us by supplying copies when asked to insure our files are correct.
Keys: By GA mandate, the MSHOA office is to have a key to each unit in case of emergency. General Manager Lucia Fregoso will be contacting owners for units missing keys. Please assist us by providing a key. They will be kept in a locked key cabinet and used for HOA business only.
Improvements: While we still have a way to go, Marina Sol has seen some significant changes in the last four years. The following is a brief list of those projects and other accomplishments:

Recycling: Bins for recyclable material have been added by the trash cans on the south end of the “A” building. To encourage recycling by owners and renters alike, it would be helpful to put two receptacles in your units; one for regular trash and one for recycling material (glass, plastic and aluminum).
Television: The board has authorized some additional equipment to make the reception going out of the office the best it can be. Please contact General Manager Lucia Fregoso if you still have signal problems so she can contact the service provider to analyze the problem.
Internet Connection: Reliable, reasonable internet access is critical. The BOD asked for volunteers at the GA meeting with computer experience to help fix our access problems. Fortunately, new owner Matt Webb “volunteered” for the job. He has 13 years experience in the field and currently leads the IT department at Sangart, Inc., a pharmaceutical company. The BOD looks forward to working with Matt.

This will continue in to the future, so it's imperative that the MSHOA office has correct contact information for all owners. Continuing GA Resolutions: Many resolutions/votes passed by the GA have continuing implications for our association, yet there is no comprehensive list. The BOD is reviewing GA minutes for the last ten years and will post the final list to the web site once completed.
Solar Power: Cabo San Lucas enjoys an average of 350 days of sunshine per year. Electrical generation using solar panels in the US is largely subsidized by local utilities. Unfortunately this is not the case in Mexico. The BOD however is looking at improvements to the passive solar system for heating the pool and hot tub to reduce our propane (stationary gas) costs.
New Owners: Welcome to new owners Nancy Stephens in D303, Matthew & Lesley Webb in D201 and Barry & Lauren Rudolph in E302. Additionally there are two other units under contract and expected to close soon.

Day of the Dead Celebration: All Souls’ Day is a holiday in Mexico on November 2nd celebrating those that have passed before us. The GA approved a fund raising event for approximately 200 people to be held at Marina Sol subject to criteria set by the BOD. The event is being planned and hosted by owner Claire Griffith.
Dues Reminder: Invoices will go out soon for the 2012 maintenance fees. Owners who pay the entire balance by January 20, 2012 will enjoy a 10% discount!
